Letter to the Editor “ It is tragic to hear of the death of Marilyn Holsten and I can believe her life was a "living hell." Her death is tragic because she was a real fighter and displayed incredible strength as she took on the eviction, and the federal medical marijuana program. MLA Jenny Kwan and I visited Marilyn and tried to get the provincial and federal governments to get better home support for her and approval for medical marijuana. Ironically, we just got a copy of the letter from the federal health minister today, saying she had been approved for the medical marijuana program, in late June. It is a telling story of our health-care system that Marilyn had to contend with so many obstacles when she was so debilitated and just needed security and medical support. The Green Party and the Liberals both want to legalize marijuana, but the NDP wants to stop at decriminalizing possession. Richard Cannings, the NDP candidate, joked however, that he was the only candidate to admit to using marijuana.

New Democrats have long said that no one should be going to jail or be stuck with a criminal record for possession of marijuana for personal use. We have pledged to decriminalize possession of small amounts of marijuana immediately.
It is clear Stephen Harper’s “war on drugs” is about ideology, not science, and the Conservatives have refused to listen or act responsibly on this file.
It has been 40 years since the LeDain Commission looked into the non-medical use of drugs and successive Liberal and Conservative governments have done nothing to update the government’s understanding of marijuana use in Canada today.
It is time to modernize our marijuana laws, move to decriminalization, and base laws on scientific evidence and public health principles.
An NDP government would seek to balance prevention, public health and well-being, harm reduction, community safety, and public education. We would also consult and work with provincial, territorial, municipal and Indigenous governments.
I also recently met with local, licensed businesses that provide medical marijuana and listened as they outlined their need for a clear federal framework for the regulation of medical marijuana.

They appointed a former police chief to handle the issue, who then encouraged police to crack down on marijuana, while continuing to hand out criminal records. Now they have appointed Anne McClellan, who has called pot “more dangerous than cigarettes”, and who was even against medicinal marijuana. How can the Liberals justify sounding more “law and order” on pot than even the Conservatives who just voted for decriminalization?

Mr. Speaker, I am very disappointed to hear that kind of response from a supposedly progressive government. The fact of the matter is that in my province of British Columbia alone, marijuana is worth $6 billion a year. The current laws are not effective. All of that money is going to criminal organizations and the people who are getting their lives ruined by getting records are people who are innocent. They get caught with possession of small amounts and have to face a charge and sentence that will profoundly impact the rest of their lives.
If I understand the parliamentary secretary correctly, that means we have more than a year of waiting while we continue with needless arrests and wasteful trials. The justice department has confirmed it is going to cost taxpayers as much as $4 million a year. It is not what a progressive government should be doing with marijuana laws.
At least yesterday the Liberal member of Parliament for Beaches—East York had the courage to publicly say that prosecution for marijuana possession is patently unfair in light of the government's future plans on this matter.
I was wondering if the parliamentary secretary could take direction from that member.

Re: Removing Cannabis from the Drug Schedule.
Dear Tracey Ramsey,
Now that the Governor General has stated (on Friday December 4th 2015) in the Speech from the Throne, "To that end, the Government will introduce legislation that will ... legalize, regulate and restrict access to marijuana". The question remains on exactly how to go about doing this. I have taken the liberty of drafting my own independent Bill that I hope Members of Parliament & The Senate will accept & adopt. I have titled and Numbered the Bill, and put it in the format of existing legislation. Attached is a PDF (and links) for Bill S-420 'Remove Cannabis from the Drug Schedule Act' This legislation clearly outlines 7 things needed to be done.
1. End the Prohibition of Cannabis by completely removing it from Schedule II, VII and VIII;
2. Repeal the Industrial Hemp Regulations, Marihuana for Medical Purposes Regulations, along with the Other Consequential regulations relating to Cannabis as a Schedule II, VII and VIII substance;
Grant amnesty for past convictions under the Controlled Drugs and Substances Act;
3.
4. Put an immediate end to arrests for simple possession and for cultivation of cannabis plants;
5. Permit personal cultivation akin to normal municipal regulations for growing garden plants at home;
6. Let the Provinces, Territories and First Nations decide how they want to (tax, regulate, control, distribute) cannabis if needed; and
7. Recognize the value of dispensaries working with any Provincial, Territorial or First Nations legal access system. Also, I am working on an e-petition for this removing of Cannabis from the drug schedule. Would you consider sponsoring it? Attached is a screen-view of it, and below is the text of the petition.

· Cannabis is the safest herbal medicine known to mankind;
· Hemp has the potential to provide food, animal fodder, medicine, fiber, fuel and building materials if unregulated;
· Cannabis prohibition causes excessive social & economic harm and prevents actualization of environmental benefits;
· Access to cannabis as medicine is a constitutional right (Section 7 of the Charter) and access is not available to all who require it;
· Prohibition fuels and finances organized crime and gang violence;
· Raids on dispensaries and consequent harm to families and businesses continue unabated despite the Liberal government's impending legalization; and
· Cannabis prohibition began as a focused effort to harass, punish and deport racial minorities across North America;
We, the undersigned, Citizens or residents of Canada, request (or call upon) the Government of Canada to Amend the Controlled Drugs and Substances Act to; 1. End the Prohibition of Cannabis by completely removing it from Schedule II, VII and VIII; 2. Repeal the Industrial Hemp Regulations, Marihuana for Medical Purposes Regulations, along with the Other Consequential regulations relating to Cannabis as a Schedule II, VII and VIII substance; 3. Without pulling punches, it is clear that Bill C-2 is part of a larger attempt by the Conservatives to align all government policies and programs with their anti-drug and abstinence ideals. They are slowly removing all avenues for Canadians to safely address their addictions at safe injection sites and to access medical marijuana for therapeutic needs.

Should we really be expending finite budgetary resources to incarcerate people who represent very little threat to public safety in Canada? I and millions of Canadians believe not.
For instance, the
inclusion of a mandatory minimum sentencing provision for persons caught
cultivating more than five marijuana plants highlights the failure of
this legislation to strike an appropriate balance between public safety
and a rational model of crime prevention.
I agree that large scale,
clandestine grow-op operations are a problem in Canada. It is unfair
for homeowners who have unwittingly bought homes that were once used as
grow-ops. They need to be protected. However, to create a regime where a
teenager growing six plants in his or her parents' basement would face
the same mandatory minimum jail sentence as organized crime groups
involved with large scale operations, fails to properly differentiate
between real and perceived threats to public safety.
Speaking of real versus
perceived threats to public safety, the bill would see tougher sentences
for persons caught cultivating marijuana than persons convicted of
certain sexual offences against children.
I will quote Serj Tankian, who said:

And law enforcement decreased,
While abolishing mandatory minimum sentences",
