During an appearance on NTV’s Issues & Answers, Liberal MP-elect for St. John’s East Nick Whalen offered insight into his party’s promise to legalize cannabis, a plan that Whalen said is, “an important thing to do.”
“Justin Trudeau has said that’s it’s not going too happen immediately, it’s going to take time.” Whalen said. “I can’t see this happening in a short time period, but i see it hopefully as something that can happen within a first term.”
Whalen said cannabis legalization will take time to ensure the government can look at issues surrounding regulation, such as how sales will be taxed.
“Each province is responsible for the civil law and the sale of goods and services in their district, so they’re going to have to be involved there,” said Whalen. “Will it be federal and provincial taxes? Will it just be provincial taxes? There’s so many nuances.”
According to Whalen, under cannabis legalization law enforcement will need to look at new issues, such as the illegal importation and sale of cannabis, similar to tobacco and alcohol, but will ultimately be better utilized compared to the current situation.
“Police services have been wasting a lot of money on something which has essentially become a norm in society,” Whalen said. “It’s not really considered to be that serious of a crime.”
One of Whalen’s main points on the slow implementation of cannabis legalization was cutting out organized crime from transitioning into legitimate players within the new framework.
“If we were going to decriminalize it immediately those distribution networks would continue to exist and would probably be the largest beneficiaries of an immediate change,” Whalen said. “We want to make sure that it’s not a situation where the bootleggers, the rumrunners of the drug trade, get all the benefits from legalization – it needs to be the state.”

Pursuant to Standing Order 45, the House proceeded to the taking of the deferred recorded division on the motion of Mr. Rankin (Victoria), seconded by Ms. Quach (Salaberry—Suroît), — That the House: (a) recognize the contradiction of continuing to give Canadian criminal records for simple possession of marijuana after the government has stated that it should not be a crime; (b) recognize that this situation is unacceptable to Canadians, municipalities and law enforcement agencies; (c) recognize that a growing number of voices, including that of a former Liberal prime minister, are calling for decriminalization to address this gap; and (d) call upon the government to immediately decriminalize the simple possession of marijuana for personal use.

When posed the question, Bonavista-Gander-Grand Falls-Windsor Liberal
MP Scott Simms didn't hesitate in admitting he has smoked marijuana.
“Yes, I've done it, and guess what? I inhaled too,” Simms said (making reference to the Bill Clinton admission that he had smoked but “never inhaled.”)
When asked if he had smoked as a sitting member of parliament, however, Simms said he had no comment.
“I've never performed my job high or drunk, as for outside of my job, that's for me,” Simms said. “I didn't get into office personally to talk about my Friday nights with friends and what exactly I do.”

She said it’s an issue that needs further study before she would support it as a part of an election platform.
Ms. Foote, Member of Parliament for Random-Burin-St. George’s, said significant debate took place before the resolution, which was put forward by the Young Liberals.
She said only one-third of the delegates were Young Liberals, and since the issue got a clear majority of 77 per cent in favour, clearly there were others besides the young people who supported the motion.
She understands the use of marijuana for medicinal purposes and has heard stories of cancer patients who have found the only relief they can get from smoking marijuana.
“We had medical doctors at the convention saying it should be legalized, young people saying it should be legalized, but on the other side you had people saying they were concerned that if it were legalized, there would be more consumption of it,” Ms. Foote said.
She said there were others on the pro side saying if it were legalized the usage of it would actually go down.
“So there is a lot of debate out there about whether this is a path you want to go down, but I’d much rather have an open discussion and see where it takes us,” Ms. Foote said.
She said there are those who point to alcohol and smoking being legal, with rules and regulations that govern it, but right now there are no rules or regulations governing the use of marijuana.
“If it (marijuana) were legalized, there would be rules governing it, so you wouldn’t have those who were selling it under the table, probably those who are associated with gangs, providing marijuana to people who are underage,” Ms. Foote said.
She recognized part of the argument is that if you legalize marijuana, then you put into place rules and regulations that govern its usage with respect to age and the availability of it.
“If you legalize marijuana, you would be sure the product you are selling is a good product. Sometimes now you don’t know what you’re getting when you’re dealing with people who are selling it on the black market,” Ms. Foote said.
There are all kinds of arguments for and against legalizing marijuana and she said she has been listening to all sides of the issue.
“But I still want to know more about it. I want more research done before the (Liberal) party takes this as part of its platform,” she said.

She said there are those who point to alcohol and smoking being legal, with rules and regulations that govern it, but right now there are no rules or regulations governing the use of marijuana.
“If it (marijuana) were legalized, there would be rules governing it, so you wouldn’t have those who were selling it under the table, probably those who are associated with gangs, providing marijuana to people who are underage,” Ms. Foote said.
She recognized part of the argument is that if you legalize marijuana, then you put into place rules and regulations that govern its usage with respect to age and the availability of it.
“If you legalize marijuana, you would be sure the product you are selling is a good product. Sometimes now you don’t know what you’re getting when you’re dealing with people who are selling it on the black market,” Ms. Foote said.
There are all kinds of arguments for and against legalizing marijuana and she said she has been listening to all sides of the issue.
“But I still want to know more about it. I want more research done before the (Liberal) party takes this as part of its platform,” she said.

That would see simple possession subject to a fine rather than jail time.
Unsurprisingly, given his party's ultra-tough stand on crime, Conservative Intergovernmental Affairs Minister Peter Penashue, the MP for Labrador, issued a statement to The Telegram saying he does not support the legalization of marijuana.
"And our government has no intention of legalizing it. That said, we are not making any changes to the law when it comes to simple marijuana possession. Rather we will continue to target the source of the illicit drug trade - the drug traffickers and those who import drugs into Canada," Penashue said.

NDP St. John's South-Mount Pearl MP Ryan Cleary wants it decriminalized.
"I feel no one should go to jail for possessing a couple of joints. I said exactly that when I stood on the floor of the House of Commons and spoke about the omnibus crime bill," he said.
"The Harper administration is imposing mandatory minimum sentences for as few as six pot plants. I don't agree with that at all."
Cleary said he can't remember the last time he went to a social gathering where there wasn't someone inside or outside smoking pot.
"It is part of our society now," he said.
"Decriminalization all the way. I am not for outright legalization at this point - one step at a time."
St. John's East NDP MP Jack Harris said the criminalization of marijuana is not an appropriate answer.
"We want an approach focused on harm reduction, rather than criminalization," he said.
"We're very concerned about the Conservatives' war on drugs. ... They're actually giving people disincentives to rehabilitate themselves by putting criminal records on them that affects the rest of their lives. ... That is wrong."
Harris said if the NDP was to form a government, decriminalization would be in order, but the party would likely seek experts and a commission to debate the merits of legalization.
Longtime Liberal Humber-St. Barbe-Baie Verte MP Gerry Byrne is not in favour of legalizing it, though he acknowledges people from all walks of life smoke the stuff.
"I am in favour of decriminalizing possession of amounts less than that intended for the purposes of trafficking," he said.
"There is a very real difference in decriminalizing versus legalization. Speeding is not a criminal offence, but it is certainly not legal. Reckless driving, on the other hand, with its potential to cause bodily harm, is a criminal offence," he said.
"I believe imposing mandatory minimum sentences of six months in prison for growing six marijuana plants will simply make hardened criminals out of otherwise peaceful, non-violent citizens. Jails have been termed by many corrections experts as 'crime colleges,' where people who would otherwise not be exposed to violent criminal elements and habits - and to addiction risk from drugs within the prison system - are suddenly cast into such situations for months on end. This can only and will only ever lead to a bad result."
Liberal Bonavista-Gander-Grand Falls-Windsor MP Scott Simms said he would entertain the idea of decriminalizing marijuana and how legislators could aid law enforcement agencies by "not having them bogged down with frivolous, small possession charges."
Judy Foote, Liberal MP for Random-Burin-St. George's, also supports decriminalization, but would need to know more about the consequences before entertaining the idea of legalizing the substance.
"I certainly support the availability of marijuana for cancer patients, which is one reason I support decriminalization. To treat someone as a criminal who gets pain relief from a disease like cancer by using marijuana would be criminal itself," she said.
Provincial Justice Minister Felix Collins declined comment, as the decision as to whether or not to legalize marijuana is in federal jurisdiction.
Legalization advocates such as Mike Dawe of the Newfoundland and Labrador Medical Marijuana Society say decriminalization can't work, as it makes it OK to possess pot, but users would still have to get it somewhere because the sale of it would be a criminal offence.

Dear Hon. Gerry Byrne,
Do you support the simple removal of cannabis as a schedule II controlled substance from the Controlled Drugs and Substances Act (S.C. 1996, c. 19)?, and let it be treated the same as Lettuce, Tomato, Oregano, Roses, Aloe Vera, Fern or any other common garden herb, flower or house plant?
Do you know the difference between Cannabis Sativa, Cannabis Indica, and Cannabis Ruderalis?
I look forward to receiving your responses as it will be made public, so then others wont need to ask you the same question.
