Vellacott highlights serious flaws in

Liberal marijuana decriminalization bill

For Immediate Release November 4, 2004

OTTAWA – This week the Conservative Party voted against the Liberal government’s misguided marijuana decriminalisation bill. “During the last Parliament, the Conservative Party, along with various police and victims groups made numerous recommendations in respect to this bill, and they have all been ignored by the Liberal government in Bill C-17,” said Conservative Member of Parliament Maurice Vellacott. “This legislation is seriously flawed and sends the wrong message regarding the seriousness of drug offences. We will be pressing for changes in the House of Commons Justice Committee.”

The Conservative Party supports eliminating criminal records for minor marijuana possession offences, but C-17 would allow for the decriminalizing of up to 30 grams of pot, enough for 30 to 60 “joints”. Vellacott indicates that allowing 30 grams leaves the door wide open for drug trafficking.

Young people should not be receiving a youth discount when it comes to drug use. Under C-17, youth receive a lesser fine for possession ($100 versus $150 for adults.) We should be sending a strong message to youth to ensure the penalties remain a deterrent for using marijuana.

“We agree with stiffer fines and jail terms for marijuana grow-ops, but the penalties are still at the discretion of judges. We need mandatory minimum sentences to ensure that judges do not continue to give sentences that are far less than the increased maximum penalties for growing,” said Vellacott.

The fines set out in the bill are much too low and do not increase for subsequent offences. There should be structures in place to force fine payment and it should be mandatory for police to issue a summons after an individual has received more than three fines.

“C-17 does nothing to address the problems this bill will create in our relationship with the United States. American officials have outlined concerns about Canada being a source of high-potency marijuana, which is coming across the U.S. border,” concluded Vellacott.

Cannabis is a schedule II drug and attracts lesser penalties. It is only if at least three kilograms are involved that trafficking and possession for the purpose of trafficking are punishable by up to life imprisonment. Production of cannabis is punishable by up to seven years' imprisonment.

The least severe penalties, up to 12 months' imprisonment on summary conviction, are reserved for offences involving substances listed in schedules IV and V.

It should be noted, however, that most of the prohibited activities in the Controlled Drugs and Substances Act are legal if committed by someone possessing the proper licence, permit or exemption.

For example, the marijuana medical access regulations that came into force on July 30, 2001 provide a comprehensive scheme for sick individuals to apply for licences to possess or grow marijuana for medical use with the support of their doctor, or in some cases with the support of a specialist. There is also a process to apply for a designated person production licence if the individual is unable to grow the marijuana himself or herself.

As such, there are individuals in Canada who are exempted from the production offence contained in the Controlled Drugs and Substances Act who are growing marijuana within their residences or in their yards.

The amount of plants that the individual is permitted to produce is derived from a formula tied to the amount of dried marijuana product which the individual holder of the permit requires on a daily basis. The amount of plants that the permit holder is authorized to produce can be quite significant. For example, it can be in excess of 50 plants.

Some members of the House may be of the view that serious drug offences do not require a response such as the one contained in the bill. However, serious drug crime is a growing problem in Canadian cities and towns and a serious legislative approach is required.

According to Statistics Canada's Juristat “Crime Statistics in Canada, 2004”, the rate of marijuana cultivation offences has more than doubled over the past decade from approximately 3,400 offences in 1994 to 8,000 in 2004.

According to a study on marijuana grow operations in British Columbia in 2003, 39% of all reported marijuana cultivation cases, or 4,514 cases, were located in British Columbia. Between 1997 and 2000, the total number of these cases increased by over 220%. Although the number of individual operations in British Columbia levelled off between 2000 and 2003, the estimated quantity of marijuana produced increased from 19,729 kilograms in 1997 to a seven year high of 79,817 kilograms in 2003, which was due to the size and sophistication of individual operations.

Recent investigations by B.C. Hydro indicate the existence of up to 17,000 possible marijuana grow operations. The increase in the illicit production of marijuana has occurred not just in British Columbia but all across this country. There is no available national data on synthetic drug production.

"Mr. Speaker, I recently met with a number of families who are concerned by a large marihuana grow operation that has sprung up in their neighbourhood.
"Shockingly, this massive grow op is considered a legal grow under the Medical Marihuana Access Program regulations set up by a previous Liberal government.
"Medical marihuana grow ops have grown out of control in my riding of Chilliwack--Fraser Canyon. Families in Chilliwack are concerned that their children, their safety and their standard of living is all put at risk when a grow op is located in their community.
"Organized crime has infiltrated the Program, and there is no ability for city officials or firefighters to even know where these so called legal grows are located.
"Fortunately, our government is making significant changes to the Program, and we will make it illegal to grow medical marihuana in neighbourhoods by March 2014.
"Unfortunately, the NDP and the Liberals have opposed our efforts to get rid of these grow ops. It's time for them to get on board with our government, keep families safe, and get marihuana grow ops out of our neighbourhoods."

Soft-on-Crime Liberals gut Conservative Crime Bill C-15

Bill C-15,An Act to amend the Controlled Drugs and Substances Act and to make related and consequential amendments to other Acts, was introduced in the House of Commons on 27 February 2009 by the Minister of Justice. Its intention was to provide for minimum penalties for serious drug offences, such as dealing drugs for organized crime purposes or when a weapon or violence is involved. Currently, there are no mandatory minimum penalties under the CDSA. The bill also increases the maximum penalty for cannabis production.Liberals in the Senate passed an amendment to Bill C-15 which removes the mandatory penalty aimed at targeting drug producers caught with anywhere between 5 to 200 marijuana plants for the purpose of trafficking. Bill C-15, which has been held up in the Senate since June, will now have to go back to the House of Commons when the session resumes in the new year. C-15 was another Bill in a long line of tough on crime measures that have been introduced by the Conservatives since first coming to power in 2006.

You do have a couple more minutes, but I want to get something here.

As you know, we'll be issuing a report on the study we're doing. Just so I understand this correctly, although we've seen this explosion in the use and quantity of medical marijuana, we have anecdotal evidence that the use of other pain relief, other medication, has diminished. That's all anecdotal.

There is no evidence, as far as data are concerned, that says, yes, the number of medications has diminished, the number of those using these medications has diminished and so has the cost. There's no evidence for that. It's more anecdotal. You have the veterans saying that they have all this medicine they don't have to take anymore. Is that correct?

Mr. Speaker, after listening to my colleague, it is obvious that the Liberals' view toward evidence-based policy is a complete farce, and here is why.

This is one of the few public policy areas where we have a perfect public policy experiment. We have legalized cigarettes. We have all the restrictions in place. We have the packaging, the warning, and cigarettes are put behind cupboards so nobody can see them. They are highly taxed. They are supposed to be kept out of the hands of kids. Has that stopped the criminal production of illegal cigarettes? Absolutely not. In fact, the criminal production and sale of cigarettes has skyrocketed in the face of these restrictions on legal cigarettes.

The exact same thing will happen in the case of marijuana. Once marijuana is legalized, we bring the price up, and we have these so-called restrictions, marijuana is fairly easy to cultivate, so there will be a major stream of illegal marijuana entering the stream of legal marijuana. Criminal profits will increase dramatically, and marijuana will be made even more available to our kids.

There is no restriction in place that the Liberals have talked about, and they have given us no specifics. This simply will not work. Can the member comment on that?

Were the parents of the students at Sioux Valley first nation school, in Manitoba, told that the Liberal leader was going to promote marijuana legalization in front of their young children? This school is right next to my constituency.

Will the parliamentary secretary explain to my constituents what our government is doing to protect children from illicit drugs?

Madam Speaker, I would like to begin by thanking my hon. friend, the member for West Vancouver—Sunshine Coast—Sea to Sky Country. I am fully aware of his deep concern for the problems that methamphetamine and ecstasy inflict on Canadians. I commend him for drawing the attention of the House through his private member's bill to the complex difficulty caused by these drugs.

Unlike other better known drugs of abuse, such as heroin, cocaine or marijuana, crystal meth and ecstasy present some unique challenges. Both are synthetic drugs. They are not dependent on the cultivation of a crop. Their production requires no specialized skill or training. The precursor chemicals needed to produce these drugs are relatively easy to obtain and inexpensive to purchase. These factors make their production attractive to both the criminal trafficker and to the addicted user.

Gail Shea says she never smoked marijuana

But when asked about the issue after a funding announcement in Bonshaw, Shea told reporters she had never smoked marijuana.
“No I haven’t and I have no intention to,” she said.
In her statement, Shea called Trudeau’s stance on marijuana legalization “reckless” and said the Island’s Liberal MPs needed to explain how legalizing it would benefit P.E.I. families.

In speaking to the media, Shea said the first policy statement from Trudeau since he became the leader was to legalize marijuana across the country.
“I think that is sending a terrible message to our population, to our youth,” she said.
