An April 2013 UNICEF study found that 28 per cent of Canadian teenagers use cannabis, the highest in the world. This shocking statistic belies the Conservatives' claim that prohibition can keep pot out of the hands of Canadian youth.

A Liberal government will pass smart laws that tax and strictly regulate marijuana, to protect our kids while preventing millions of dollars from going into the pockets of criminal organizations and street gangs.

This isn't wild theory but precisely what happened after Colorado regulated and taxed marijuana: cannabis prosecutions dropped 77 per cent, burglaries and robberies declined and the state has collected an additional $23.6 million in revenue.

Letter to the Editor “ It is tragic to hear of the death of Marilyn Holsten and I can believe her life was a "living hell." Her death is tragic because she was a real fighter and displayed incredible strength as she took on the eviction, and the federal medical marijuana program. MLA Jenny Kwan and I visited Marilyn and tried to get the provincial and federal governments to get better home support for her and approval for medical marijuana. Ironically, we just got a copy of the letter from the federal health minister today, saying she had been approved for the medical marijuana program, in late June. It is a telling story of our health-care system that Marilyn had to contend with so many obstacles when she was so debilitated and just needed security and medical support. The Green Party and the Liberals both want to legalize marijuana, but the NDP wants to stop at decriminalizing possession. Richard Cannings, the NDP candidate, joked however, that he was the only candidate to admit to using marijuana.

“Before any of the other parties would even talk about this, we have advocated for the decriminalization of marijuana,” said Cannings. “We don’t think a person who smokes the odd joint should be thrown in jail.”

 3. Do you personally believe in criminal penalties for recreational marijuana use?

Since 2000, court rulings have made it legal for Canadians to possess and grow small amounts of cannabis for medicinal purposes.  I have become aware that there are approximately 9000 medicinal marijuana users in Vernon alone, representing close to 1 in 4 adults.  My concern remains, as it does with the Conservative party, that young people under the age of 16 who become regular users may have negative health outcomes.

New Democrats have long said that no one should be going to jail or be stuck with a criminal record for possession of marijuana for personal use. We have pledged to decriminalize possession of small amounts of marijuana immediately.

It is clear Stephen Harper’s “war on drugs” is about ideology, not science, and the Conservatives have refused to listen or act responsibly on this file.

It has been 40 years since the LeDain Commission looked into the non-medical use of drugs and successive Liberal and Conservative governments have done nothing to update the government’s understanding of marijuana use in Canada today.

It is time to modernize our marijuana laws, move to decriminalization, and base laws on scientific evidence and public health principles.

An NDP government would seek to balance prevention, public health and well-being, harm reduction, community safety, and public education. We would also consult and work with provincial, territorial, municipal and Indigenous governments.

I also recently met with local, licensed businesses that provide medical marijuana and listened as they outlined their need for a clear federal framework for the regulation of medical marijuana.

They are spending over $4 million a year prosecuting people for simple possession. Nelson Daily asked each candidate in the Kootenay/Columbia riding what their party’s stance on marijuana is. NDP candidate Wayne Stetski, responded by saying: “Medicinal marijuana is already legal in Canada, with the federal government issuing approvals. . . . Medicinal marijuana, as already determined by the Supreme Court of Canada, should be available in a variety of forms.” He also stated: “The challenge for municipalities is whether or not to allow marijuana operations in the community, and under which zoning and conditions. It is important, in my opinion, not to have large medicinal grow-ops located in residential areas due to potential odour and safety concerns. Storefront locations also need to be carefully located and the conditions of the licenses enforced. . . . We need to have further study and research on the benets and harms of marijuana, and we need a real eort to properly educate the public on this matter.” Mr. Stetski, however, failed to comment on what his party’s position is on mandatory minimum sentences in regards to cannabis.

I'd like to continue along with what we were just talking about a bit in regard to the idea of blockages as well as access. It's about looking at the power of the colleges across the country to influence where things go.

I'll go back a step. I've had a number of doctors speak to me about the use of medicinal marijuana as an example of where we have something that's legal, but it's only somewhat clear in the profession about what's allowed or what's not allowed. I've had some physicians say that they won't prescribe because it's unclear with the CMPA what the liabilities are. Some feel that the colleges of various jurisdictions will single them out if they're participating too much in prescribing.

I'm hoping you can put my mind at ease and say that the colleges will be enablers as opposed to setting up barriers to access. We've heard a lot about conscientious objection. There will be a body of physicians who simply don't want to participate and I'm hoping that won't influence the professional bodies that oversee this to create disincentives for participation. That could come through any number of ways. It can be sanctions. It can be the threat of sanctions. It can be threatening, or reducing the scope of licences because of over-prescribing whatever, or over-participation, or not doing a full range of things. We've had some discussions about whether people specialize in this. Does it limit their ability to practice the full range of medicine?

I would like to hear from your perspective, from the colleges' perspectives, about how we ensure that we don't end up with arbitrary restrictions or limitations to access and actually are able to enable those physicians. We've heard that upwards of 30% are showing support for participating. How do we ensure they are able to participate in physician-assisted dying initiatives and not have the colleges hanging over them?

Mr. Speaker, it has been interesting to hear members of the NDP as well as of the government talk a lot about other jurisdictions. Yet, when I asked the parliamentary secretary if he could name a single jurisdiction where decriminalization or legalization led to a decrease in use, he was not able to name that jurisdiction. I wonder if the NDP, given that they are advocating this course, can do better. All the evidence I have read suggest that, for better or worse, there is an increase in use when we make the law more permissive, and that is only logical.

As well, with respect to the Conservative position, some members have said that we support decriminalization, which we certainly do not. We instead passed a motion, and I supported it, to have a ticketing option, to continue to have marijuana be a criminal offence, but to allow police to use a ticketing option. I would consider that a middle way that would allow for effective enforcement in a range of different kinds of situations.

I would like to know, in addition to this question about jurisdiction, if the member has thoughts on that as an option for addressing the situation we face, but also continuing to have that strong sense that marijuana really is associated with significant health problems.

“Opportunity” is a word I would like to focus on. What exactly does opportunity mean? To me, opportunity means having the freedom to accomplish all that one has ever dreamed of. It means having options available for one to succeed. Opportunity means having a good-paying job, economic stability, and the hope that tomorrow will always bring better things. Unfortunately, the Speech from the Throne by the newly minted government lacks opportunity. At a time when the world economy is fragile and families are struggling, the government appears to have its priorities not on jobs and the economy but on rhetoric and the legalization of marijuana.

The energy sector has been the greatest source of wealth creation across Canada and yet does not merit a mention in the throne speech. It is the largest employer of first nation people in Canada and yet does not merit a mention in the throne speech. It is Canada's biggest export to the world's markets and yet—everyone is sensing a trend, I am sure—does not merit a mention in the throne speech. However, marijuana does. I know that pot has been a focus for the Liberal Party both during the election and beforehand, but it should not be the focus of the government's agenda. The throne speech offers empty platitudes, not opportunity for Canada.

LW: I was a member of the Alberta alcohol and drug abuse commission before I became an MLA. I was on the commission for a number of years and I got to travel around the entire province and go into facilities where individuals were fighting alcohol and drug addictions. I also met with many addiction counsellors and many experts on addictions and every one of them, every scientist, every doctor told me that marijuana is a gateway to harsher drugs. I personally don’t want to see marijuana legalized in any way. The trafficking of marijuana is a serious crime and it should continue to be.

LW: No I have not, but I’ve been around people who have and I’m sure I was affected by secondhand smoke.

Mr. Speaker, after the Liberal leader promised he would be the pro-pot Prime Minister, Canadians are becoming increasingly concerned about the Liberals' rightward shift. They appointed a former police chief to handle the issue, who then encouraged police to crack down on marijuana, while continuing to hand out criminal records. Now they have appointed Anne McClellan, who has called pot “more dangerous than cigarettes”, and who was even against medicinal marijuana. How can the Liberals justify sounding more “law and order” on pot than even the Conservatives who just voted for decriminalization?

Similar to Craft Beer, 'Craft Cannabis', is where it's small independent growers who provide limited quantity.  Unlike, the licenced producers model, Craft Cannabis growers can provided the unique variety that people are asking for.

Similar to how there are high-end coffee and slow-food, farm-to-table nieches.   Considering that there are really countless opportunities that cannabis can be incorporated into other available products, it must be reminded that Cannabis is not just about smoking it.   Cannabis infused drinks, lates, and foods all have their potential.

The Government of Canada, is asking Canadians to submit their views on how to go about the 'Legalization and Regulation of Marijuana' http://healthycanadians.gc.ca/health-system-systeme-sante/consultations/legalization-marijuana-legalisation/index-eng.php

As you probably already know, i don't support regulation, as it's a Plant, and a herb.  The PDF document discussion paper from Health Canada even states that 'A marijuana overdose is not fatal'.   So WHY should it even be regulated at all??  It seems silly that it's even in the CDSA (Controlled Drugs and Substances Act) in the 1st place.  I'm calling for the removal of cannabis from the CDSA, and let the provinces, first nations, territories do what they like. 

I've gone through, and posted each of the 21 Questions that are asked, and made them as blog posts.  (as well as put it in the Document, and made an Evernote post about it.   From now until August 20th (or so) I'll submit my version earlier than the 29th, i'm asking for your input on this, so my answers will be what more people like.   I'm sending a copy of my answers to all MPs and Senators, so perhaps my views could be noticed more than most, so i want to make them as clear as possable.

What type of cannabis? There should be no conditions.   Or rather, for smoking in the joint form, just not near doorways to public buildings. But these are all MUNICIPAL regulations. The Federal Government should have nothing todo with this. 

Cannabis - in its juiced form, should most certainly be allowed on a bus. Its not dangerous.  As long as its in a close-able container.
And cannabis is far less of a riskier than cigarettes.

Portugal.  Be BOLD.  Don't be a follower, be a LEADER that you claim to be.   Just remove cannabis from the CDSA, as a matter of public interest, and let the provinces sort it out.

Possible Options

  1. Phased-in approach to distribution: In the initial stages of legalizing marijuana, only allowing a proven system of distribution (e.g., through the mail, as is currently done in the medical marijuana regime) could minimize the risks of uncontrolled/illegal retail sales outlined above. This system could enable access for adults while using caution in taking a step that may inadvertently put youth at increased risk.
  2. Storefronts: On the other hand, allowing for some ability for the sale of marijuana to occur in a legal, regulated retail environment may be required in order to provide an alternative to the current illegal sellers that exist in certain Canadian cities. Ensuring that the marijuana sold in such establishments comes from a legal source would be critical.
  3. Local choice: Alternatively, decisions on appropriate distribution mechanisms could be left to provincial and territorial governments to determine the best approach based on their unique circumstances. This scenario could result in different models being adopted across the country.


The question is a loaded one.  Storefronts should be permitted, as well as local choice. Best practices will soon be found out, then rules will be changed accordingly.  No laws should be written in stone.
